Drivingtestnow.co.uk provides its services to you, subject to the following Terms of Service (‘TOS’). In these TOS ‘you’ means the individual using the DrivingTestNow.co.uk services and ‘Service’ means DrivingTestNow.co.uk and the software it promotes. These TOS may be updated from time to time without notice to you. You should review the TOS periodically for changes at http://www.drivingtestnow.co.uk/terms-of-service.

In order to use the Service, you must first agree to the Terms below:

  1. You accept the Terms by actually using the Service. In this case, you understand and agree that your usage of the Service will be treated as an acceptance of the Terms from that point onwards. You may not use the Service if you do not accept the Terms.
  2. DrivingTestNow.co.uk assumes no responsibility or liability for this service which you agree to use solely by your own responsibility. The Service is provided on an ‘As is’ and ‘As available’ basis.
  3. By using this Service and providing your driving licence details you give us permission and authority to make changes to your driving test dates and test centres on DSA website on your behalf.
  4. Drivingtestnow.co.uk has no affiliations or connections to any of the companies or testing organizations, including DSA / DVLA, and therefore subscription to this service does not guarantee that you will receive an earlier driving test slot.
  5. You assume all risks of using this service and website and agree to not hold DrivingTestNow.co.uk and its employees responsible for any reason. You acknowledge that use of our site is at your sole risk. The site is not warranted to be error free or uninterrupted, and there is no warranty as to the results obtained through use of the site. You acknowledge, by your use of the site, that your use of the site is at your sole risk, and that you assume full responsibility and that drivingtestnow.co.uk shall not be liable for any damages of any kind related to your use of the site.
  6. You acknowledge and agree that the Service contains proprietary and confidential information that is protected by applicable intellectual property and other laws. You further acknowledge and agree that content or information presented to you through the Service is protected by copyrights, trademarks, service marks, patents or other proprietary rights and laws. Except as expressly authorised by Drivingtestnow.co.uk, you agree not to modify, rent, lease, loan, sell, distribute or create derivative works based on this Service in whole or in part.
  7. Drivingtestnow.co.uk grants you a personal, non-transferable and non-exclusive right and licence to use its Service; provided that you do not (and do not allow any third party to) copy, modify, create a derivative work of, reverse engineer, reverse assemble or otherwise attempt to discover any source code, sell, assign, sub-licence, grant a security interest in or otherwise transfer any right in the Service. The foregoing is subject to applicable statute and other express law. You agree not to modify the Source code of this Service in any manner or form, or to use modified versions of the Service, including (without limitation) for the purpose of obtaining unauthorised access to the Services. You agree not to access the Service by any means other than through the interface that is provided by Drivingtestnow.co.uk for use in accessing the Service.
  8. Any request for a refund must be made within 28 days of purchasing the software. Refund requests made after 28 days will always be declined. Refund requests made inside of the 28 day period may be subject to the Driving Test Now support team trying to rectify any issues. If at any point during your usage of the service the software/service has found you an earlier driving test and attempted to notify you by either email or SMS, your refund request may be declined. All refund requests are dealt with on a case by case basis and should be initiated by email to refunds@drivingtestnow.co.uk
  9. Given the nature of the service, installed applications need to be left running in order to find earlier driving tests. We appreciate that people don't want to leave their computers on continuously, and that's fine. For the purposes of our money back guarantee we have to set some limits as to what we deem a "reasonable" amount of time to leave the software running before you can request a refund. We deem a "reasonable" amount of time to be a minimum of 2 weeks (14 days) with the software being left on for an average of 12 hours a day (this is 66% of the DSA websites available time).
  10. Drivingtestnow.co.uk accepts no responsibility for incompatabilities that are detailed in the frequently asked questions section of the website. If a customer purchases the software without first reading this section or contacting customer support to check for any incompatabilities with their system, drivingtestnow.co.uk will not offer a refund. Drivngtestnow.co.uk reserve the right to completely refuse a refund, but may, under some circumstances, offer a "transfer of license" to the user whereby they may transfer their license to another user (e.g. friend or relative).
  11. If a customer requests a refund for the reasons of the software being incompatible with their specific setup, (such as they are unable to upgrade .NET Framework, they have firewalls which block the software, etc.), Driving Test Now reserve the right to refuse a refund, if the user is unwilling or unable to recitfy their incompatabilities. Where possible Driving Test Now will detail incompatabilities in their FAQ section. Whilst Driving Test Now do not offer support in this situations, one of our support team may be willing to help rectify these types of issues through the usage of advice and/or upgrades to our software. Whilst refunds are not given for incompatabilities with the software, as a gesture of goodwill Driving Test Now may decide to offer a percentage of the original cost of the software. This is determined on a case by case basis, and is calculated based on the amount of support provided by the Driving Test Now support team.
  12. As per the consumer protection act of 2000, you are entitled to cancel your purchase within 7 days of purchase so long as the service hasn't began when you decide to cancel. Please see the consumer protection act for more details.
  13. We record many details of usage of the software. This includes, but is not limited to, times the software is started, the number of checks it has made, the details of tests it has found, your mobile number, email address, driving license and both practical and theory test details. This data may be stored locally on your computer or device as well as remotely on our servers.
  14. your statutory rights are not affected by any of the above terms.
